Ok, enough sarcasm. But really, the main reason for a lawyer in New York will lose their license if they do not the money you receive, as part of a settlement or a jury.

We have all heard about the lawyers who steal money from their customers, and wind up losing their license, but also go to jail. How does this happen?

Without the motivation for a lawyer to do something so unethical, one of two things will usually trigger the starting point of the investigation:

(1) The lawyer will give you only a part of the solution, and then gives an excuse why he can not give you the full amount. This may cause the client to a complaint to the Appeals Committee, which then begins to investigate.

(2) The other reason is that if a lawyer writes a check payable to "Cash" from an escrow account that is a red warning flag that something is wrong. Also, if the lawyer overdraws money from his trust account, an automatic warning to the Appeal Committee, triggering an investigation.

If a lawyer uses some of your settlement money and puts it in his personal account to pay his bills, (this is known as "co-mingling" of money) There is an excellent opportunity for your lawyer is on the way to lose his (or their) license.

Fortunately that is not often. If yes, is there a fund for the customer to find that the money has been stolen by their lawyer. It is designed as a client protection fund. Every lawyer in New York State pays them as a way to the bad apples from the good. Hopefully you'll never suffer the humiliation of a lawyer to steal your money, especially if this lawyer is required by law and by legal ethics to the money in trust for you. It is your injuries. It is your compensation.
