The owner or harbor an animal if the animal causes around either personal or property damage to persons, shall be liable for damage to person, irrespective of the animal owner or the lack of harbor SCIENTER the vicious or dangerous propensities of the animal.

The owner or harbor an animal which is known by its form or nature as dangerous, wild, or vicious if the animal causes around either personal or property damage to any person who is absolutely liable for the damage.

According to HRS § 663.9, persons, the injury caused by an animal must still prove negligence on the part of the animal, the owner or harbor to harbor or the owners liable for the breach. The general rule for all landowners in Hawaii is that an owner of land who knows or should have known of an unreasonable risk to people involved in the country from a state in the country, owes a duty to persons who the country to take reasonable steps to minimize the risk, inappropriate, or warn the user against them. Under Hawaii law, an owner or keeper of domestic animals is to take note of the general propensities of the class to which it belongs, and also of a certain inclinations peculiarities of the animal itself, from which he or she has knowledge of the notice and insofar as such propensities are of a nature to cause injury he must exercise reasonable care to guard against and prevent them from injuries, which can reasonably be expected of them. In this context, the vicious or dangerous propensity is available or can from the mere mischievousness and playfulness of the animals, because of their size or nature, could lead to injury, because it is the act of the animal, but as the state of his mind, the cost of the owner or operator's liability. Under Hawaii law, a pet owner / harbor is legally responsible for injuries and damages caused by the animal around.
