The mission of the Patent Office is to ensure the patent system contributes to a strong economy, innovation and entrepreneurship support. As part of this mission, the patent office examines patent applications and patents to questions the applicant meets the statutory requirements for patent protection. Once the Patent Office issues a patent, the patent owner from legal enforcement of rights in patent by filing a patent infringement claim in federal court. Since the presumption of the courts of a patent is valid, a party to a patent unenforceable due to inequitable conduct must prove both materiality and intent by clear and convincing evidence.

Once a threshold determination of materiality and intent are established, the court balances the materiality of the information with the intention of the accused to determine whether the shares justify inequitable conduct conclusion. A finding of inequitable conduct renders all claims of the patent is not enforceable and can have a negative effect on patents created by the inequitable behavior.
